Intellectual property

All content on funkybreslev.com (texts, images, audio and video productions, logos, databases, musical compositions and productions) is protected by the French Intellectual Property Code. Any reproduction, performance, distribution or use, in whole or in part, without prior written permission is prohibited and constitutes infringement (Articles L.335-2 et seq. of the French Intellectual Property Code).

The musical productions sold on this site are covered by a private, non-commercial listening licence, set out in article 9 of the Terms of sale.

Mediation and applicable law

Consumer mediation: see article 14 of the Terms of sale. This notice is governed by French law; for jurisdiction, see article 17 of the Terms of sale.

Liability

FunkyBreslev uses reasonable means to keep the site available and secure. It cannot be held liable for service interruptions, bugs, viruses or indirect damage linked to use of the site, except in cases of gross negligence, wilful misconduct or personal injury. This clause does not affect the rights that consumers hold under the mandatory provisions of French consumer and civil law, in particular the legal guarantee of conformity and the guarantee against hidden defects.

Terms of sale

1. Purpose

These terms of sale (“Terms”) govern sales of digital and physical products made through funkybreslev.com between FunkyBreslev (“the Seller”) and any adult individual who is not acting as a trader (“the Customer”). Every order implies acceptance of the Terms, by a box ticked on the payment page. The Terms that apply are those in force on the date of the order.

2. Seller

FunkyBreslev, Isabelle Tachez (sole proprietor, auto-entrepreneur), SIRET 10184367000015, 132 A Rue Joliot Curie, 69160 Tassin la Demi-Lune, France. E-mail: contact@funkybreslev.com. Phone: +33 7 43 27 45 57. VAT not applicable, Article 293 B of the French General Tax Code.

3. Products and prices

Prices are shown in euros, inclusive of all taxes (VAT not applicable), at the time of the order; the price that applies is the one shown at that moment. The amount to pay is calculated by the server at the time of payment.

  • Single track: €1.50 per track, as a download. Offers may apply, as shown in the basket. “Buy 5 singles = get 2 free”: in a single basket, for every 7 single tracks, the first 5 are paid for and the next 2 are free (with 6 tracks, 1 is free); the free tracks are the cheapest ones.
  • EP (2 to 7 tracks): €7; album (8 tracks or more): €10, as a download. A track from an EP or album can also be bought on its own, €1.50.
  • The Collection, digital version: €59. It brings together the tracks released on the date of the order, as mastered MP3 (320 kbps), delivered immediately as a download archive. It also gives access to “My music”. Content reserved for buyers of The Collection may be offered.
  • USB flash drive option: the buyer of The Collection may choose to also receive it on a USB flash drive. The total is then the price of The Collection plus €6, delivery in France included (€65 without discount). The USB flash drive is only delivered in France for now. The buyer keeps the digital access and “My music”. The USB flash drive holds the tracks released on the date of the order, as mastered MP3 (320 kbps), in a FunkyBreslev case with a booklet.

Discounts: the best one applies, one at a time; the referral discount is added on top, and combines with “Buy 5 singles = get 2 free”, but not with the 40% discount nor with the deduction of what has already been paid. The amount is calculated by the server and shown before payment. Former Pass subscribers and buyers of The Collection, when signed in: 40% off for three months, on the dates given by e-mail. If the Customer has already paid for tracks or content included in The Collection, that amount is deducted from the price (up to the price of The Collection). Referral: €5 off the referred person’s first purchase (at most half the basket), only for an e-mail address with no previous purchase and granted once per address (the e-mail is then asked for in the basket), and €5 credit for the referrer (credit deducted from the next purchase, never paid out, valid for 12 months, 3 credits at most).

The main features of each product are given on its page.

4. Ordering and payment

The order is placed on the site, then paid on Stripe’s secure payment page. On the Stripe payment page, the Customer ticks a box accepting the Terms and requesting immediate supply of the digital content, acknowledging the loss of the right of withdrawal; without it, payment is not possible. The confirmation e-mail recalls this request.

Payment is handled by Stripe; the Seller keeps no bank details. The order is binding once the payment is confirmed. The Seller may refuse an order for a legitimate reason (unusual order, suspected fraud, previous dispute).

5. Delivery of digital products

Access is immediate once payment is confirmed: purchases are available in the “My music” area, and a secure, personal, time-limited download link is sent by e-mail. If the link expires, a new one can be requested at contact@funkybreslev.com.

6. Delivery of the USB flash drive

The USB flash drive is shipped from France by La Poste with tracking; an e-mail with the tracking number is sent at dispatch. Delivery charges are included in the price (the price of The Collection plus €6, i.e. €65 without discount). The USB flash drive is delivered in France only for now. Estimated time: 2 to 4 working days; it is shipped no later than 30 days after the order. The Seller is not liable for delays caused by the carrier. If the carrier declares the parcel lost (after an inquiry with La Poste), the Seller re-ships it or refunds the Customer in full, at the Customer’s choice. Physical products remain the Seller’s property until paid in full.

7. Right of withdrawal

Digital products: the Customer expressly waives the right of withdrawal, as requested by ticking the box on the payment page. USB flash drive: the 14-day right of withdrawal remains valid. Details in the “Withdrawal” section below.

8. Legal guarantees

The professional answerable for these guarantees is FunkyBreslev, Isabelle Tachez (contact details in Article 2 above and in the legal notice). The two boxes below reproduce the official statutory notice.

Informative translation; the French text prevails.

Independently of these Terms, the Customer benefits from the legal guarantee of conformity (Articles L.217-3 et seq. of the French Consumer Code: action within 2 years of delivery of the goods or supply of the digital content; repair, replacement, termination of the contract or price reduction as provided by law) and from the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code: action within 2 years of discovering the defect). To rely on them: contact@funkybreslev.com.

USB flash drive (goods) — annex to Article D. 211-2 A of the French Consumer Code

The consumer has a period of two years from delivery of the goods to obtain application of the legal guarantee of conformity if a lack of conformity appears. During this period, the consumer only has to establish that the lack of conformity exists, not the date on which it appeared.

Where the sales contract for the goods provides for digital content or a digital service to be supplied continuously for a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the planned period of supply. During this period, the consumer only has to establish that the lack of conformity affecting the digital content or digital service exists, not the date on which it appeared.

The legal guarantee of conformity obliges the professional, where applicable, to provide all the updates necessary to maintain the conformity of the goods.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of the request, free of charge and without major inconvenience to the consumer.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the original guarantee.

If the consumer asks for the goods to be repaired but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction of the purchase price while keeping the goods, or end the contract and be refunded in full against return of the goods, if:

1° The professional refuses to repair or replace the goods;

2° The repair or replacement of the goods takes place after a period of thirty days;

3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer permanently bears the cost of taking back or removing the non-conforming goods, or bears the cost of installing the repaired or replacement goods;

4° The lack of conformity of the goods persists despite the seller’s unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to first ask for the goods to be repaired or replaced.

The consumer is not entitled to termination of the sale if the lack of conformity is minor.

Any period during which the goods are immobilised for repair or replacement suspends the guarantee that remained to run until the goods are handed back in working order.

The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who in bad faith obstructs the application of the legal guarantee of conformity incurs a civil fine of up to 300,000 euros, which may be raised to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept, or to a full refund against return of the goods.

Music files (digital content supplied in a single act) — annex to Article D. 211-3 of the French Consumer Code

The consumer has a period of two years from the supply of the digital content or digital service to obtain application of the legal guarantee of conformity if a lack of conformity appears. During a period of one year from the date of supply, the consumer only has to establish that the lack of conformity exists, not the date on which it appeared.

The legal guarantee of conformity obliges the professional to provide all the updates necessary to maintain the conformity of the digital content or digital service.

The legal guarantee of conformity entitles the consumer to have the digital content or digital service brought into conformity without undue delay following the request, free of charge and without major inconvenience to the consumer.

The consumer may obtain a price reduction while keeping the digital content or digital service, or may end the contract and be refunded in full against giving up the digital content or digital service, if:

1° The professional refuses to bring the digital content or digital service into conformity;

2° Bringing the digital content or digital service into conformity is unjustifiably delayed;

3° Bringing the digital content or digital service into conformity cannot take place without costs being imposed on the consumer;

4° Bringing the digital content or digital service into conformity causes major inconvenience to the consumer;

5° The lack of conformity of the digital content or digital service persists despite the professional’s unsuccessful attempt to bring it into conformity.

The consumer is also entitled to a price reduction or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination. The consumer is then not required to first ask for the digital content or digital service to be brought into conformity.

Where the lack of conformity is minor, the consumer is entitled to cancellation of the contract only if the contract does not provide for payment of a price.

Any period during which the digital content or digital service is unavailable so that it can be brought back into conformity suspends the guarantee that remained to run until the digital content or digital service is supplied again in conformity.

The rights mentioned above result from the application of Articles L. 224-25-1 to L. 224-25-31 of the French Consumer Code.

A professional who in bad faith obstructs the application of the legal guarantee of conformity incurs a civil fine of up to 300,000 euros, which may be raised to 10% of average annual turnover (Article L. 242-18-1 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects under Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the digital content or digital service is kept, or to a full refund against giving up the digital content or digital service.

9. Licence

All products sold are covered by a private, non-commercial listening licence only. Without the Seller’s prior written permission, the following are prohibited: public broadcast (social media, clubs, bars, shops, etc.); audiovisual synchronisation (advertising, film, series, online video, etc.); streaming or uploading to a third-party service; resale, redistribution and sharing of the files; any professional or commercial use, direct or indirect. Any breach constitutes infringement (Articles L.335-2 et seq. of the French Intellectual Property Code).

10. Accounts and the “My music” area

Sign-in is by a link sent by e-mail. Purchases are kept in “My music”. Purchases and access to the tracks you have bought are never deleted because of inactivity. After three years without signing in, comfort data (favourites, listening statistics) is erased. An account with no purchase that stays inactive for three years is deleted.

11. Premium Pass

The Premium Pass has no longer been on sale since 15 October 2026. For existing subscribers, the current subscription runs until its end date; automatic renewal has been stopped, so there is no renewal left to cancel. For any request: contact@funkybreslev.com.

When the Pass ends, everything released up to that date stays the Customer’s in “My music”, for as long as the account exists. Tracks released after the end of the Pass are in The Collection. Files downloaded during the subscription remain the subscriber’s for private, non-commercial use (article 9).

12. Customer service

E-mail: contact@funkybreslev.com. Address: 132 A Rue Joliot Curie, 69160 Tassin la Demi-Lune, France. The Seller aims to reply within 5 working days.

13. Personal data

See the “Privacy” section.

14. Consumer mediation

Under Article L.616-1 of the French Consumer Code, if a dispute cannot be settled amicably with customer service, the Customer may use a consumer mediator free of charge: CM2C (consumer mediation centre of justice conciliators), 14 Rue Saint Jean, 75017 Paris, France, www.cm2c.net.

15. Liability and force majeure

The Seller uses reasonable means to keep the site available, the delivered files intact and transactions secure. The Seller is not liable for service interruptions, data loss, bugs, viruses or indirect damage, except in cases of gross negligence, wilful misconduct or personal injury, nor for failure to perform caused by force majeure within the meaning of Article 1218 of the French Civil Code. This clause does not affect the Customer’s mandatory rights (legal guarantee of conformity, hidden defects).

16. Changes to the Terms and partial invalidity

The Seller may change the Terms at any time; they apply to orders placed after they are published on the site. If any provision is declared void, the others remain fully in force.

17. Applicable law and jurisdiction

The Terms are governed by French law. For disputes with a consumer, the jurisdiction rules of the French Consumer Code and Regulation (EU) No 1215/2012 apply: the consumer may bring proceedings before the courts of their place of residence or those of the Seller. For disputes with a business, the courts of Lyon (France) have exclusive jurisdiction.

Withdrawal

Digital content (tracks, EPs, albums, digital Collection)

Digital content is delivered immediately after payment. On the Stripe payment page, the Customer ticks a box accepting the Terms and requesting immediate supply of the digital content, waiving the right of withdrawal (Article L.221-28, 13°, of the French Consumer Code); without it, payment is not possible. The confirmation e-mail recalls this waiver. No withdrawal is therefore possible for digital content once the access or download link has been received.

USB flash drive (physical item)

For the USB flash drive, the Customer has 14 days from receiving the item to withdraw, without giving any reason (Article L.221-18 of the French Consumer Code).

To do so, the Customer notifies the decision by e-mail to contact@funkybreslev.com or by post to the Seller’s address, using the form below or any other unambiguous statement. The item is sent back in its original packaging within 14 days of the notification; return costs are borne by the Customer. The Seller then refunds the sums paid within 14 days of receiving the returned item (or proof of its dispatch), using the same payment method as the order.

Exception under Article L.221-28, 5°, of the French Consumer Code: the right of withdrawal cannot be exercised for sealed audio recordings that have been unsealed after delivery. The USB flash drive is shipped in sealed packaging.

Mixed order (digital The Collection and USB flash drive): the digital content is delivered immediately, with express waiver of the right of withdrawal; the 14-day right of withdrawal applies to the USB flash drive only. If the Customer withdraws from the key, the Seller refunds the extra amount paid for the key (€6), delivery charges being included in that price. The digital access to The Collection remains acquired by the Customer. Return costs for the key are borne by the Customer. The key must be returned in its sealed packaging: an unsealed key holds a copyable audio recording, which is excluded from the right of withdrawal by Article L.221-28, 5°, of the French Consumer Code.

Cookies

The site sets only one cookie, your “My music” sign-in, which it needs to work. It also uses Umami, an audience measurement tool that sets no cookie. To count its visitors, it also keeps a random number in your browser, unrelated to your account, renewed every 13 months; statistics are kept for 25 months at most.

In “My music”, the listening time of each track is recorded on your account, to see which tracks are listened to; it is kept for 400 days at most and deleted on request.

It only keeps, in your browser and on your device, what it needs to work:

  • the contents of your basket (browser local storage), so you find it again when you come back;
  • the last preview you played (session storage, cleared when you close the tab);
  • when you sign in to “My music”, the sign-in token (secure cookie), needed to stay signed in;
  • your e-mail entered at the basket (local storage);
  • a randomly drawn visit number (session storage), used to count visits; the visit summary is kept for 100 days.

These items stay on your device, are strictly necessary for the service you asked for and are exempt from consent. You can clear them at any time in your browser settings.

The payment page is hosted by Stripe, which may set its own cookies there that are necessary for payment and security (see Stripe’s policy). Links to YouTube and TikTok open those sites only after you click; they are then subject to their own policies.
